C. Michael Smith
Litigation Partner
Michael Smith is the principal litigation partner in the Calgary law firm of Smith Mack Lamarsh. Since graduating from the University of Alberta in 1977, Michael has engaged in the general practice of law throughout the province of Alberta. Michael’s general practice lead to one concentrated on litigation of all kinds.
Michael has experience at all levels of the Courts, in both civil and criminal litigation and for the Prosecution as well as for the Defence.
Michael has also appeared in the Court of Appeal for the North West Territories, the Supreme Court for the NWT and the Territorial Court for what is now Nunavut, on a special case basis.
Michael has appeared before various Administrative Tribunals including professional discipline panels, both defending and prosecuting. His experience includes involvement in construction litigation and defence of Occupational Health and Safety charges, including successful defences of the Government of Alberta and its employees from O H & S prosecutions.
Michael has extensive experience defending O H & S prosecutions and advising clients how to avoid prosecution and how to prepare against a prospective prosecution. Michael has also delivered numerous speeches and seminars concerning Occupational Health and Safety from a legal perspective.
